use of the ATIITHI website, Manufacturing Operating System,
software platform, applications, products, and related
services.
By accessing, registering for, or using ATIITHI, you acknowledge
that you have read, understood, and agreed to be legally bound
by these Terms. If you do not agree with these Terms, you must
discontinue the use of our website and services immediately.
2. About ATIITHI
ATIITHI is a Manufacturing Operating System designed to help
manufacturing businesses manage production planning,
inventory, procurement, quality control, machine monitoring,
workforce management, costing, logistics, analytics, reporting,
and related manufacturing operations through a centralized
software platform.
ATIITHI continuously improves its products and reserves the
right to modify, enhance, suspend, or discontinue any feature
or service at its sole discretion.
3. Definitions
For the purpose of these Terms:
- Platform refers to the ATIITHI website, software,
applications, services, and related technology.
- User means any individual authorized to access or use
ATIITHI.
- Customer means the business entity or organization
subscribing to ATIITHI.
- Account means a registered user account.
- Services means all software, features, modules, APIs,
support, and related services provided by ATIITHI.
- Customer Data means all business information,

ATIITHI reserves the right to suspend or terminate accounts

10. Intellectual Property Rights
All intellectual property rights relating to ATIITHI, including
software, source code, user interfaces, graphics, branding,
logos, documentation, workflows, trademarks, designs, and
related materials remain the exclusive property of ATIITHI or its
licensors.
Nothing in these Terms grants ownership of ATIITHI intellectual
property to users.
11. Customer Data Ownership
Customers retain ownership of all business data uploaded,
entered, or generated through ATIITHI.
ATIITHI processes and stores such information solely for the
purpose of providing the subscribed services.
Subject to applicable law and these Terms, ATIITHI does not
claim ownership over customer business data.
12. Data Backup & Recovery
ATIITHI implements commercially reasonable measures to
protect customer information and maintain service continuity.
However:
- Customers are encouraged to maintain independent
backups of business-critical information.
- ATIITHI does not guarantee that data loss will never occur.
- ATIITHI shall not be liable for loss of data resulting from
customer actions, third-party infrastructure failures, cyber
incidents, internet failures, force majeure events, or
circumstances beyond ATIITHI's reasonable control, to the
maximum extent permitted by applicable law.
13. Third-Party Services & Infrastructure
ATIITHI relies on trusted third-party service providers including
cloud hosting providers, communication providers, payment
gateways, infrastructure providers, analytics platforms, and
other technology partners.
Service interruptions, outages, delays, or failures caused by
such third-party providers are outside ATIITHI's direct control.
ATIITHI shall not be responsible for service disruptions arising
solely from failures of third-party infrastructure.
14. Platform Availability
ATIITHI strives to provide reliable and continuous services.
However, the Platform is provided on an "as available" basis
and uninterrupted availability cannot be guaranteed.
Temporary interruptions may occur due to maintenance,
technical issues, infrastructure failures, internet disruptions, or
other operational circumstances.
15. Scheduled Maintenance
ATIITHI may periodically perform maintenance, upgrades,
security improvements, or infrastructure updates.
Where reasonably practicable, advance notice of scheduled
maintenance will be provided through appropriate
communication channels.
During scheduled maintenance, certain services may be
temporarily unavailable.
16. Emergency Maintenance
ATIITHI reserves the right to perform emergency maintenance
without prior notice where necessary to protect platform
security, stability, infrastructure, customer data, or compliance
with applicable laws.
17. Service Interruptions
ATIITHI shall not be responsible for temporary interruptions
resulting from:
- Cloud provider outages
- Internet failures
- DNS failures
- Power outages
- Cybersecurity incidents
- Hardware failures
- Telecommunications disruptions
- Force majeure events
- Other events beyond ATIITHI's reasonable control
ATIITHI will make commercially reasonable efforts to restore
services as soon as reasonably practicable.
18. Data Accuracy & User Responsibility
ATIITHI provides tools to assist manufacturing operations.
Customers remain solely responsible for:
- Data entered into the platform
- Inventory quantities
- Production records
- Purchase records
- Quality records
- Business decisions
- Regulatory compliance
ATIITHI is not responsible for inaccuracies arising from
incorrect or incomplete information provided by users.
19. Business Decision Disclaimer
ATIITHI provides software tools, reports, analytics, dashboards,
and operational insights.
All operational, financial, production, inventory, procurement,
quality, staffing, purchasing, and management decisions
remain solely the responsibility of the customer.
ATIITHI does not provide legal, financial, accounting,
engineering, or professional advisory services.
20. Limitation of Liability
To the maximum extent permitted by applicable law, ATIITHI
shall not be liable for any indirect, incidental, consequential,
special, exemplary, or punitive damages, including loss of
profits, business interruption, loss of goodwill, or loss of
business data arising from the use of or inability to use the
Platform.
Nothing in these Terms limits liability where such limitation is
prohibited by applicable law.
21. Suspension & Termination
ATIITHI may suspend or terminate access to the Platform
where users:
- Violate these Terms.
- Engage in unlawful activities.
- Fail to make required payments.
- Compromise platform security.
- Misuse ATIITHI services.
Customers may terminate their subscriptions in accordance
with applicable subscription agreements.
22. Changes to Services
ATIITHI may introduce new features, improve existing
functionality, modify services, discontinue certain features, or
make operational changes to improve the Platform.
Where reasonably practicable, significant changes will be
communicated in advance.
23. Changes to Terms
ATIITHI reserves the right to revise these Terms from time to
time.
Updated Terms become effective upon publication on the
ATIITHI website unless otherwise stated.
Continued use of ATIITHI after updated Terms are published
constitutes acceptance of the revised Terms.
24. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in
accordance with the laws of India.
Any disputes arising from or relating to these Terms shall be
subject to the exclusive jurisdiction of the competent courts
located in Ahmedabad, Gujarat, unless otherwise required by
applicable law.
